This Privacy Policy describes how Content With Tony, LLC ("Provider," "we," "us," or "our") collects, uses, shares, and protects personal information. This Policy applies to all websites, courses, and services operated by Provider, including but not limited to:

- The Stay At Home Marketer course and program
- The Create & Convert program
- Any associated community spaces, affiliate programs, and email communications
By using any of our services or making any purchase from us, you acknowledge that you have read and understood this Policy.
1. Definitions
- "Personal Information" means information that identifies, relates to, describes, or could reasonably be linked with a particular individual or household.
- "Sensitive Personal Information" means precise geolocation, racial or ethnic origin, religious beliefs, financial account credentials, government-issued identifiers, biometric data, health data, sexual orientation, or contents of mail, email, and text messages.
- "You" or "User" means any individual whose personal information we collect or process.
- "Services" means our websites, courses, programs, communities, affiliate program, and related products.
2. Information We Collect
We collect personal information in the following categories, mapped to definitions used by the California Consumer Privacy Act ("CCPA"):
Identifiers: Name, email address, phone number, mailing address, billing address, IP address, account login credentials, and unique online identifiers (such as device ID and cookie ID).
Customer Records: Payment information (processed by our payment processors; we do not store full credit card numbers on our servers), tax identification (W-9 or W-8 forms for affiliates), and account purchase history.
Commercial Information: Records of products purchased, purchase dates, payment plan status, refund history, and affiliate transactions.
Internet or Network Activity: Browsing history within our Services, course progress and lesson completion, device and browser type, referring URLs, pages viewed, time spent, click data, and interactions with marketing emails.
Geolocation: Approximate location derived from IP address. We do not collect precise geolocation.
Audio, Visual, and Similar Information: Photos, videos, voice memos, or testimonials that you voluntarily submit to us.
Professional or Employment Information: Information you voluntarily share regarding your career, business, or industry, including in coaching calls, community posts, or program submissions.
Inferences: Profiles drawn from the above, such as content preferences, learning progress patterns, or marketing-segment categorization.
Sensitive Personal Information: Login credentials. We do not knowingly collect other categories of Sensitive Personal Information.
We do not knowingly collect personal information from children under 13. See Section 14.
3. Sources of Information
We collect personal information from the following sources:
- Directly from you, when you create an account, purchase a product, register for an event, contact support, post in a community, or submit a testimonial
- Automatically, when you interact with our Services (cookies, pixels, log files, analytics tools)
- From third parties, including our payment processors (Stripe, PayPal), course platform (Kajabi), community platform (Skool), email service providers, advertising platforms (Meta, TikTok, Google), and affiliate networks
- From publicly available sources (such as social media profiles you have made public)
4. How We Use Your Information
We use personal information for the following purposes. Where applicable to residents of the European Economic Area, the United Kingdom, or Switzerland, we have indicated the GDPR lawful basis for each processing purpose.
To provide and operate our Services (Lawful basis: contract performance) — Including delivering course access, processing payments, fulfilling purchases, providing customer support, managing community access, and administering affiliate programs.
To personalize your experience (Lawful basis: legitimate interests) — Including tracking course progress, recommending content, and displaying tailored materials.
To communicate with you (Lawful basis: contract performance for transactional messages; consent for marketing) — Including transactional communications (purchase confirmations, login details, course updates), customer support, and promotional communications where you have opted in.
To improve our Services and content (Lawful basis: legitimate interests) — Including analyzing usage patterns, conducting research, troubleshooting, and developing new features or programs.
To process payments and prevent fraud (Lawful basis: contract performance and legal obligation) — Including verifying transactions, identifying suspicious activity, and complying with tax reporting obligations.
To use AI tools to support program delivery (Lawful basis: legitimate interests) — We may use AI tools (including third-party tools such as ChatGPT or Claude) to help us draft program materials, respond to support queries, or analyze trends. We do not use student personal information to train third-party AI models without consent.
To comply with legal obligations (Lawful basis: legal obligation) — Including responding to lawful requests by public authorities, complying with tax reporting requirements, and enforcing our Terms.
To protect our rights and the rights of others (Lawful basis: legitimate interests) — Including investigating violations, defending against legal claims, and ensuring the security of our Services.
We will not use your personal information for materially different purposes without notifying you and, where required, obtaining your consent.
5. How We Share Your Information
We share personal information with the following categories of recipients, and only as necessary:
- Service providers and contractors who help operate our business, including payment processors, course platforms, community platforms, email service providers, analytics providers, and customer support tools. These providers are contractually obligated to use information only as directed and to maintain reasonable security.
- Coaches and instructors who deliver elements of our programs.
- Affiliate program participants, in limited form, to credit referrals and process payments.
- Legal authorities, when required by law, valid legal process, or to protect against fraud or harm.
- Business successors, in the event of a merger, acquisition, or sale of all or part of Provider's business; affected users will be notified.
We do not share personal information for cross-context behavioral advertising in a manner that constitutes a "sale" or "sharing" under CCPA, and we have not done so in the preceding twelve (12) months.
6. Sale and Sharing of Personal Information
We do not sell or share personal information as those terms are defined under the CCPA, and we have not done so in the preceding twelve (12) months. We do not knowingly sell or share personal information of consumers under 16 years of age.
7. Cookies and Tracking Technologies
We use cookies, pixels, and similar tracking technologies in the following categories:
- Strictly Necessary: Required for our Services to function (login session, shopping cart, security).
- Functional: Remember your preferences (language, display settings).
- Analytics: Help us understand how visitors use our Services. We use Google Analytics and Kajabi's built-in analytics.
- Marketing: Help us deliver relevant content and measure ad campaign effectiveness. We use the Meta Pixel and TikTok Pixel, where applicable.
You can manage cookies through your browser settings. Disabling cookies may affect functionality.
We honor opt-out preference signals where required, including the Global Privacy Control (GPC). When we detect a GPC signal from your browser, we will treat it as a request to opt out of sale or sharing as required by California law.
We do not currently respond to "Do Not Track" browser signals, as no industry-standard interpretation of those signals exists, but we honor GPC.
8. Your Privacy Rights
Depending on your location, you may have the following rights regarding your personal information:
- Right to Know / Access: Request a copy of the personal information we hold about you.
- Right to Delete: Request deletion of personal information, subject to legal retention obligations.
- Right to Correct: Request correction of inaccurate personal information.
- Right to Opt Out of Marketing: Unsubscribe from promotional emails at any time.
- Right to Withdraw Consent: Where processing is based on consent, withdraw consent at any time.
- Right to Data Portability: Receive a copy of your personal information in a structured, machine-readable format.
- Right to Object: Object to certain types of processing.
- Right to Lodge a Complaint: File a complaint with a supervisory authority.

We will respond within forty-five (45) days for CCPA requests (extendable to ninety days if reasonably necessary, with notice) or within thirty (30) days for GDPR requests. We may need to verify your identity before fulfilling a request.
You may also designate an authorized agent to make a request on your behalf. We will require written verification of the agent's authority and may require you to verify your identity directly.
We will not discriminate against you for exercising any of these rights. We will not deny services, charge different prices, or provide a different level of quality based on your exercise of privacy rights.
9. California Residents (CCPA / CPRA)
If you are a California resident, you have the rights described in Section 8, plus the following:
- Right to Limit Use of Sensitive Personal Information: You may request that we limit our use of your Sensitive Personal Information to purposes necessary for providing our Services.
- Right to Non-Discrimination: As described in Section 8.
- Right to Opt Out of Sale or Sharing: As described in Section 6, we do not sell or share personal information; you may confirm or update this preference at any time by contacting us.
The categories of personal information we have collected, used, disclosed, and retained in the preceding twelve (12) months are described in Sections 2, 4, 5, and 11 of this Policy.

We are not required to retain personal information collected for a single, one-time transaction if such information is not sold or retained by us.
10. EEA, UK, and Switzerland Residents (GDPR)
If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the rights described in Section 8, governed by the General Data Protection Regulation (GDPR) and equivalent UK and Swiss laws.
Lawful bases for processing are described in Section 4.
International Data Transfers: Provider is based in the United States. When we transfer personal information out of the EEA, UK, or Switzerland, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission, the UK Information Commissioner's Office, or other appropriate safeguards.
Right to Lodge a Complaint: You may file a complaint with your local supervisory authority. A list of EEA supervisory authorities is available at https://edpb.europa.eu/about-edpb/about-edpb/members_en.
Data Protection Officer: We do not currently have a designated Data Protection Officer. For privacy questions, contact tony@contentwithtony.com.
Automated Decision-Making: We do not engage in automated decision-making that produces legal effects or similarly significant effects on you.
11. Data Retention
We retain personal information for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required by law. Specific retention periods include:
- Account information: Retained for as long as your account is active, plus three (3) years after closure.
- Purchase records: Retained for seven (7) years to comply with tax and accounting obligations.
- Email subscription data: Retained until you unsubscribe, plus thirty (30) days for processing.
- Affiliate tax forms: Retained for seven (7) years, as required by IRS regulations.
- Marketing communications data: Retained for two (2) years after last interaction.
- Course progress data: Retained for the duration of your access to the program.
- Community posts: Retained as part of the community archive unless you request deletion.
After applicable retention periods, we delete or anonymize personal information.
12. Data Security
We use reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, loss, misuse, alteration, or destruction. These measures include encryption in transit (TLS/SSL), access controls limiting personal information to authorized personnel, regular review of security practices, and contractual obligations on our service providers.
No transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee absolute security.
In the event of a data breach affecting your personal information, we will notify you and applicable supervisory authorities as required by law, generally within 72 hours of becoming aware of the breach where required by GDPR.
13. Marketing Communications
We send promotional emails only to users who have opted in to receive them. Every promotional email includes an unsubscribe link, in compliance with the CAN-SPAM Act. Unsubscribe requests are processed within ten (10) business days.
Transactional communications (such as purchase confirmations, login details, and customer support responses) are not subject to unsubscribe and may continue regardless of marketing preferences, as they are necessary to deliver the Services you have purchased.
14. Children's Privacy
Our Services are not directed to children. We do not knowingly collect personal information from children under thirteen (13) years of age in compliance with the Children's Online Privacy Protection Act (COPPA). For purchases, we additionally require users to be eighteen (18) years of age or older.
If we become aware that we have inadvertently collected personal information from a child under 13, we will delete that information promptly. If you believe we may have collected information from a child under 13, please contact us at tony@contentwithtony.com.
15. Third-Party Links and Services
Our Services may contain links to third-party websites and integrations with third-party platforms (such as Skool, Kajabi, social media platforms). We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing them with personal information.
16. Changes to This Policy
We may update this Policy from time to time. The "Effective Date" and "Last Updated" dates at the top reflect when the current version became active. If we make material changes, we will notify you by email (to the address associated with your account) or by posting a prominent notice on our Services at least thirty (30) days before the changes take effect.
Your continued use of our Services after the new Effective Date constitutes acceptance of the updated Policy. If you do not agree to the changes, you must discontinue use of the Services. This does not affect your refund rights under our Terms and Conditions.
